Terms and Conditions of Sale (TCS)
Article 1: Scope of Application and Modification of the TCS (Terms and Conditions of Sale)
These general terms and conditions of sale apply without restriction or reservation to any order placed on Domobip. We reserve the right to modify them at any time, and these modifications will apply immediately to orders. Furthermore, the choice and purchase of a product are the sole responsibility of the customer.
Domobip is a sales platform that offers remote controls and receivers for gates and garage doors as well as accessories (flashing lights, key switches, photoelectric cells, brackets, etc.).
Our TCS are available at any time on the Domobip website, in the 'Information' section of the footer. When placing an order with Domobip, the customer declares that they have read our TCS herein by checking a box provided for this purpose.
Article 2: Product Prices
An order is paid for by secure online payment, namely by credit card, in full on the day of placing the order. Payment data is exchanged in encrypted mode using the protocol defined by the authorized payment service provider (Crédit Agricole) involved in bank transactions carried out on Domobip.
Payments made by the customer will only be considered final after effective collection by the seller of the amounts due. The seller will not be required to deliver the products ordered by the customer if the customer does not pay the full price in accordance with the conditions stated above.
All current rates will be indicated at the time of the Customer's order. In other words, the rates will be firm and not subject to revision during the validity period of an order. However, we reserve the right, outside this validity period, to modify the prices of products at any time.
Prices are indicated in Euro including VAT, excluding shipping, transport, and delivery costs, these costs being indicated before order validation. All orders are payable exclusively in Euro. A delivery note will be provided to the customer with the delivery of the ordered products, and an invoice will be automatically available on the order summary tab.
Article 3: Orders
It is the customer's responsibility to select on Domobip the products they wish to order. The customer can add the selected products to the cart and then click on it to access the summary, thus allowing them to order the products. The customer selects or provides a delivery address and a billing address after their registration/login on Domobip. Then the customer chooses the delivery method, consults and accepts the TCS, and validates the payment method and the order summary before confirming their order.
Article 4: Delivery
After confirmation of the order and subject to full payment of the agreed price, Domobip undertakes to deliver to its carrier, all the items ordered by the purchaser, and this, within a maximum period of 30 days from the day following that on which the customer placed their order.
Products are delivered to the address specified by the customer when ordering. The customer will be informed by email of the shipment of their order.
Domobip undertakes to make its best efforts to deliver the products ordered by the customer within the deadlines specified above. However, these deadlines are communicated for information purposes only. If the products ordered have not been delivered within 30 days after the indicative delivery date, for any reason other than force majeure or the customer's fault, the sale may be canceled at the customer's written request under the conditions laid down in Articles L. 216-2, L. 216-3, and L. 241-4 of the French Consumer Code. The sums paid by the customer will then be returned to them at the latest within 14 days following the date of termination of the contract, excluding any compensation or withholding.
Article 5: Withdrawal
In accordance with Article L. 221-18 of the French Consumer Code, the customer has a period of fourteen clear days from the delivery of their order to exercise their right of withdrawal without having to justify reasons or pay penalties, except, where applicable, return costs.
Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be re-marketed in new condition, accompanied by a copy of the purchase invoice for optimal management.
Article 6: Guarantees
All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for by Articles 1641 et seq. of the French Civil Code.
In case of non-conformity of a product sold, it can be returned, exchanged, or refunded. All claims, requests for exchange or refund must be made by email within thirty days from the date of delivery.
Article 7: Liability
Domobip, in the process of online sales, is bound only by an obligation of means; its liability cannot be held liable for any damage resulting from the use of the Internet network such as data loss, intrusion, virus, service disruption, or other unintended problems.

Article 8: Intellectual Property
All elements of the Domobip website are and remain the exclusive intellectual property of Domobip. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio.
Article 9: Personal Data
Domobip reserves the right to collect personal information and personal data about customers. They are necessary for the management of orders, as well as for the improvement of the services and information we send to customers.
Article 10: Archiving - Proof
Domobip will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the French Civil Code.

Article 12: Modification of the Terms and Conditions of Sale
Domobip reserves the right to modify the terms and conditions of sale at any time. In the event of a change, the applicable conditions will be those in effect on the date of the order by the customer.
Article 13: Applicable Law
All clauses appearing in these general terms and conditions of sale, as well as all purchase and sale transactions referred to herein, will be subject to French law.
Article 14: Attribution of Jurisdiction
All disputes to which the purchase and sale transactions concluded under these general terms and conditions of sale could give rise, concerning their validity, interpretation, execution, termination, consequences, and repercussions, as well as the obligations which they generate, will be subject to the jurisdiction of the competent courts under the conditions of common law.
